These Terms of Service (“Terms”) govern your access to and use of the BLK LUV website, mobile application, and related services (collectively, the “Service”) operated by BLK LUV (“we”, “us”, or “our”). By using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and 18, you confirm that you have obtained parental or legal guardian consent to use the Service. We do not knowingly collect personal information from children under 13. Accounts registered by bots or automated methods are not permitted.

2. User Accounts

To access certain features, you must create an account using a valid Nostr public/private key pair or another authentication method we support. You are responsible for safeguarding your private key and for all activity under your account. Notify us immediately at info@blkluv.org if you suspect unauthorised access.

3. Content You Post

The Service allows you to upload, share, and publish videos, images, text, and other material (“User Content”). You retain all ownership rights to your User Content. By posting, you grant BLK LUV a non‑exclusive, royalty‑free, worldwide license to host, store, display, and distribute your User Content solely to operate and improve the Service. This license ends when you delete your content or close your account, except to the extent necessary to comply with legal obligations or resolve disputes.

You represent and warrant that: you own the User Content or have the necessary licenses, rights, and permissions; your User Content does not infringe any third party’s intellectual property, privacy, or publicity rights; and your User Content complies with these Terms.

4. Prohibited Content & Conduct

You may not use the Service to post, share, or facilitate any content that:

• Is illegal, promotes illegal activity, or violates any applicable law or regulation.
• Contains child sexual abuse material (CSAM), non‑consensual intimate media, or any form of exploitation of minors.
• Depicts extreme violence, self‑harm, or suicide.
• Is harassing, bullying, defamatory, abusive, threatening, or incites hatred or violence against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic.
• Contains spam, deceptive practices, phishing, or malware.
• Infringes copyrights, trademarks, or other proprietary rights (see Section 6 regarding DMCA).

You also agree not to:

• Use the Service to distribute unsolicited commercial messages (“spam”).
• Impersonate another person or entity, or falsely state your affiliation.
• Attempt to bypass any security features, rate limits, or access controls.
• Interfere with the proper working of the Service or attempt to gain unauthorised access to our systems.

5. Copyright & Intellectual Property (DMCA)

We respect intellectual property rights and expect users to do the same. If you believe that any content on the Service infringes your copyright, please send a notice to our designated agent at info@blkluv.org with:

• Identification of the copyrighted work claimed to be infringed.
• Identification of the material that is claimed to be infringing, including a URL or other specific location.
• Your name, address, telephone number, and email address.
• A statement that you have a good faith belief that use of the material is unauthorised.
• A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on their behalf.
• Your physical or electronic signature.

We will respond to valid DMCA notices and may terminate accounts of repeat infringers.

6. Third‑Party Services & Nostr Relays

BLK LUV integrates with the Nostr protocol and relies on third‑party Nostr relays and Blossom media servers. We are not responsible for the availability, security, or content of these external services. Your use of such services is at your own risk and subject to their respective terms.

7. Termination

We may suspend or terminate your access to the Service at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may delete your account at any time by contacting info@blkluv.org. Upon termination, your license to use the Service ends, but we may retain archival copies of your content as required by law.

8. Disclaimers & Limitation of Liability

The Service is provided “AS IS” and “AS AVAILABLE”. We do not warrant that the Service will be uninterrupted, error‑free, secure, or free from viruses. To the fullest extent permitted by law, BLK LUV disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non‑infringement.

To the maximum extent permitted by applicable law, in no event shall BLK LUV, its directors, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or relating to these Terms or your use of the Service, even if advised of the possibility of such damages. Our total liability shall not exceed the amount you paid us (if any) in the past 12 months.

9. Indemnification

You agree to indemnify and hold harmless BLK LUV and its officers, employees, and agents from any claims, losses, liabilities, or expenses (including reasonable attorneys’ fees) arising out of your User Content, your violation of these Terms, or your violation of any third‑party rights.

10. Governing Law & Dispute Resolution

These Terms shall be governed by the laws of the State of Delaware, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, and judgment on the award may be entered in any court having jurisdiction. Class actions are not permitted; you agree to bring claims only in your individual capacity.

11. Changes to These Terms

We may revise these Terms from time to time. If we make material changes, we will notify you by posting the new Terms on this page and updating the “Last updated” date. Your continued use of the Service after the changes become effective constitutes your acceptance of the revised Terms.
